Framework and Guideline for a Model Submarine Cable Construction Contract

These documents have been developed by a group of experts within the industry, on a volunteer basis, to provide an insight into a critical but often misjudged and misunderstood part of all that makes up a submarine cable project.

These Construction Contract Frameworks are not intended to be used as the de-facto finished agreement – however, it will provide a sound introduction to the structure and the purpose of the Contract for the novice, and it will form a baseline for discussions and negotiations helping to deliver clarity and speed to this critical project phase. The Construction Contract Guide, which forms an integral part of each model, will provide the reader with the perspective of both the supplier and the buyer, and an understanding of what collateral activities and dependencies have to be taken into account to ensure success.

Two versions of these documents are available.

The first one which was presented at SubOptic 2010, was developed by a group under the leadership of Keith Schofield from Pioneer Consulting, and is based essentially upon a single purchaser and a single supplier, though it can be developed for larger groupings. This model can be downloaded here.

Subsequent to SubOptic 2010, a group led by Francis Charpentier from FT Orange, developed a second model more suited to a Consortium based project, where a number of purchasers agree the implementation of a cable network. This introduces some concepts which are more suited for this application and took as its starting point a typical contract document used for an ITT.
